DAPA stands for Deferred Action for Parental Accountability

DAPA, known as "Deferred Action for Parental Accountability and Lawful Permanent Residents" is a form of immigration relief where a non-citizen may be granted to opportunity to remain in the U.S. temporarily. Additionally, individuals covered under DAPA may also apply for an employment authorization document (i.e. a work permit). DAPA cases are reviewed on a case-by-case basis and there are a number of eligibility requirements:

To be eligible for relief, individuals must meet certain qualifications:

  • You must have been present in the US since at least January 2010 and must have continuously resided in the U.S. since that date.
  • Have U.S. citizen child or children
  • Not have been convicted of any felony or “significant” misdemeanor or three or more misdemeanors.
  • Not be an enforcement priority

EXPANSION OF DACA

The new executive order removes the age cap. Those who are otherwise eligible for DACA i.e. entered the US before age 16 and before June 15, 2007. They will be eligible even if they were born before June 15, 1981. Also, the DACA period is extended to three years rather than 2.

EXPANSION OF THE PROVISIONAL WAIVER PROGRAM

The provisional waiver program is expanded to all eligible relatives for whom there is a visa immediately available. For example, spouses of permanent residents will now be eligible for a provisional waiver in the U.S. and then go to their immigrant visa interview at the U.S. consulate in their country, rather than first going to the interview at the U.S. consulate in their home country and then apply and wait for the waiver while outside the U.S.
